Dear Steven,

Thank you for writing eBay in regard to your shipping price concern for
the items you purchased from "tandpstuff". Please accept my apology for
the delay in responding to your email.

To address your concern about shipping charges, I’d like to inform you
that eBay has recently begun taking measures to ensure that all concerns
about excessive shipping are addressed and any violations are remedied.
However, many of these steps will take some time to implement. In the
meantime, the seller is responsible for determining the shipping and
handling charges. Although eBay encourages sellers to clearly describe
the charges in the listing, so that buyers understand the terms, they
are not required to do so. In every case, buyers should confirm with the
seller what the total cost of shipping and handling will amount to prior
to bidding.

Also, there are some instances in which additional services, such as
signature or delivery confirmation, may cost extra. There may also be
additional expenses that the seller incurs when selling their items. I
hope you understand that sellers may also take this into account when
determining shipping and handling charges.

More information can be found here:

  http://pages.ebay.com/help/sell/shipping-faqs.html

Of particular interest is the subheading "Amounts Charged for Shipping"
as this will explain why the rates may vary.

As eBay is only a venue, we cannot verify if a seller is making a profit
on the shipping of their products. For example, an item you purchased
has an actual shipping fee of one dollar. The actual shipping charge on
the packaging may not reflect the true expenditure needed to send the
package to you. Things such as the packaging itself, a third party
mailing service, travel to and from the location they mail their items
from if they live in a rural area. As you can see, these are just few of
the factors that may be used to determine shipping and handling charges.
If you are ever unsure about the shipping and handling a seller is
charging, you may contact the seller directly and ask about those
charges.

To request the seller's phone number, follow these steps:

1. Click the "Advanced Search" link at the top of most eBay pages.

2. Click the "Find Contact Information" link under the "Members" heading
on the left side of the page.

3. Enter the member's User ID and the Item number.

4. Click the "Search" button.

Lastly, always remember to be sure that you understand and agree to the
shipping charges before placing a bid on an auction. Generally, it is
best to address any questions or concerns to the seller prior to bidding
as their answer to those questions could greatly affect your desire to
purchase the item.

If you need further assistance, please don't hesitate to reply to this
email and let us know.

Sincerely,
Hal

Dear Steven,

Thank you for writing eBay in regard to your report about reporting
seller "tandpstuff" and his shipping price which you find excessive.

Steven, I understand  your concern. I've reviewed the listing you've won
item number 280194639256 and I noticed that your seller had included a
Shipping Rate Calculator in estimating the shipping price of the item,
in  placing your postal code in it, the calculator shows a value of
$20.89 which is the same shipping price listed in the invoice the seller
had sent you.

I understand that you feel that this amount is excessive and I
understand your concern. At this time, I would encourage you to contact
your seller directly and try to work this out. I would recommend that
you communicate with him directly and ask him about the  shipping price
in his auction and amicably find a solution that could work for the both
of you.

To contact the seller, follow these steps:

1. Go to the item page and click on the seller's name.
2. Then click on the "Contact Member" button on the Member Profile page.
3. Write a message to the seller explaining your issue and then click
"Send."

If you prefer, you may want to ask your seller about the reason for his
shipping amount requested. If he told you that he's not satisfied with
the winning bid or that he would be using the money to cover up for his
eBay or PayPal fees, then this must be considered as a form of Fee
Avoidance. To report such activity, I would ask you to send us  a copy
of the email you received where the seller stated his reason for
excessive shipping. To report such incident please go to:

http://pages.ebay.com/help/policies/listing-circumventing.html
http://pages.ebay.com/help/policies/listing-shipping.html

What should you know for future reference?

The seller is responsible for determing the shipping and handling price
of their listed items. We always advise the bidders to be very careful
when bidding on auctions.  It is important that they read the entire
description so that there are no surprises if the seller has listed a
high shipping cost.  If you do not notice any specifics on shipping, you
should always contact the seller before placing a bid.

Listing items at a very low bidding price and high shipping price is
usually considered Fee Circumvention.  However, in order to take action
against these reports, the auctions must be reported before they have
ended.  Otherwise, we cannot take action against such a violation.

If you prefer,  you may also would want to consider offering your seller
to mutually cancel the sale. We can release both of you from obligation
to complete the transaction, but the process involved needs to be
initiated by the seller.

If you and your seller have agreed not to complete the transaction, your
seller can receive credit without harming your reputation. If the
seller's request for a Final Value Fee states that an amicable agreement
was reached, then going through the Unpaid Item process will not
negatively reflect on your eBay account.

As the cancellation of this transaction must be initiated by the
seller, I have provided you with information about this process. If the
seller does not know how to do this, please pass this information on to
him.

In these circumstances, eBay does not refund the initial listing fee. If
your seller would like to receive a credit for the Final Value Fee,
please have him or her follow our Unpaid Item Process.

To begin the Unpaid Item Process, please have your seller follow the
steps below:

1. Click on the "My eBay" button located at the top of any eBay page.
You may be asked to log in if you haven't already.

2. Next, click on the "All Selling" link located on the left-hand side
of the page.

3. From there, click on the "Report an Unpaid Item" link located under
the "Related Links" section on the left side of the page.

4. From this page, you will be prompted to enter the item number and
instructed on how to proceed from there.

For more information about this process, and to file for Final Value Fee
credit, please go here:

http://pages.ebay.com/help/policies/unpaid-item-process.html

Again, let me reassure you that if you and the seller mutually agree not
to complete the sale, this will not reflect negatively on your account,
nor result in an Unpaid Item warning.

Also, I have reviewed all the emails you have sent us and it would seems
to me that you were also previously trying to report an excessing
shipping listing however, the listings you were trying to report
(280194639256 and 70205892056) seems to be already ended. I greatly
appreciate your effort in trying to report to us potential policy
violation and if you ever saw such listing you can easily report such
listings by clicking on the "Report This Listing" link at the bottom of
that listing page.

You can also report such listings by following the steps below:

1. 1) go to www.ebay.com

2) Click "Help" at the top of the page

3) Click "Contact Us" on the left side

4) Check the radio button : Listing Violations

5) Click "Continue".

6) Under Step 1 : Select a subtopic, Listing policy violations (improper
keywords, outside links, excessive shipping, etc)

7) Under Step 2 : Select a subtopic, choose "Other listing policy
violations"

8) Under Step 3 : example choose "Miscategorized items"

9) Click "Continue"

10) Click "Email Us" in the middle

11) Fill out the information with as much details as you can so that the
Trust and safety team can investigate the situation in greater detail.

It seem as though ebay is geared towards the seller and not the buyer, why would anyone want to contact the seller over a dispute, ebay representatives should settle a dispute.

Can I retract or cancel my bid?

A bid may be retracted (canceled) by the buyer in some cases if the retraction meets the requirements of our Bid Retraction policy.

Note: There is no equivalent for bid retraction in Buy It Now listings, or for listings where the bidding has ended. Once you've confirmed your purchase, you are obligated to pay the seller. There is also no equivalent for bid retraction for item listings using the Best Offer feature.

Whether you can retract your bid or not depends on the following factors:

  • Why you are retracting your bid.
  • When your bid was placed and when the listing ends.

You can retract a bid or a Best Offer for the following reasons:

  • You make a typographical error and enter the wrong bid amount. For instance, you bid $99.50 instead of $9.95. If this occurs, enter the correct bid amount immediately after you retract your bid. If you do not place another bid, the retraction will be in violation of eBay's policy and could result in your suspension. Please review the retraction guidelines if you need to retract your bid.
  • The description of an item you have bid on changed significantly after you placed your bid.
  • You cannot contact the seller. This means that you tried to call the seller, but the seller's phone number doesn't work, or that you have tried emailing a message to the seller and it comes back undeliverable.
When your bid was placed What is allowed What is not allowed
More than 12 hours before the listing ends You can retract a bid with more than 12 hours left before the listing ends. When you do this, all your previous other bids will also be eliminated. Be sure to bid again if you are correcting a bidding error that you made. You cannot retract the bid during the last 12 hours of the listing, unless the seller agrees.

Please contact the seller to request that your bid be canceled. However, it is up to the seller's discretion whether or not to cancel your bid.

Less than 12 hours before the listing ends You can retract a bid within one hour of placing it. In this case, only that bid will be retracted; any other bid you placed before the last 12 hours of the listing remains valid.

Restriction: Your total number of bid retractions in the past six months is displayed in your Feedback Profile. eBay will thoroughly investigate bid retractions. Abuse of this feature may result in the suspension of your account. Bids retracted within the last 24 hours of a listing may be viewed as bid shielding, which is a serious violation of our policy.

Note: If you retract a bid on an active item that is in a Bid Assistant group, the entire group will be closed. No other bids will be placed on items in the group.

To retract a bid, use the Bid Retraction form.

To retract a best offer, use the Best Offer Retraction form.

Dear samccaleb,

No action is being taken against your account at this time. However, it is important to remember that when you bid on or buy an item you are agreeing to a contract between you and the seller. Losing Feedback Privileges

Though it happens rarely, there are some circumstances when members can lose Feedback privileges. When a buyer fails to respond to an Unpaid Item notification and the seller issues an Unpaid Item strike against them, the buyer can still leave a Feedback comment, but the Feedback rating they leave for the transaction will not appear and will not count toward the seller’s Feedback Score.

An eBay administrative note will appear under the Feedback comment on the Feedback Profile page, explaining that the member did not participate in the Unpaid Item process.

You should always respond to disputes opened within the Unpaid Item process. If you have resolved the situation outside of this process (for example, by making a payment by phone or email), please go back to the Dispute Console to enter a comment. Otherwise, you may lose your Feedback privileges for that transaction.

Note: When an Unpaid Item dispute is closed automatically, the buyer will lose Feedback privileges immediately. This happens when the buyer is no longer a registered user of eBay at the time of the Unpaid Item filing.

Unpaid Item Policy

Buyers automatically enter into a legally binding contract to purchase the item from the seller if they win the online auction or use the Buy It Now feature. eBay's Unpaid Item policy requires buyers to pay the seller for the items that they commit to purchase.

Sellers can file an Unpaid Item dispute with eBay for each of their items that are purchased but not paid for. eBay will issue a strike on the account of the buyer who does not honor their obligation to pay (unless the buyer and seller mutually agree not to complete the transaction).

Note: If a buyer gets too many strikes in too short a time period, their account will be suspended indefinitely. In some cases, limits may be placed on the buyer’s account in advance of suspension.

But yet ebay will allow a seller to charge Excessive Shipping Charges, so is ebay working for the buyer of the seller. What I can tell most people charge a descent shipping charge, then there are some that make a living on Excessive Shipping Charges. Please be careful!!!

I sent the seller an email stating that I have requested my bid be canceled and that I have requested ebay intervene on my behalf on what I believe to be Excessive Shipping Charges.

Dear Steven,

Thank you for writing eBay in regard to your recent transaction with
tandpstuff.

We are very concerned about violations on the site and have thoroughly
investigated your report. The eBay Privacy Policy prevents me from
discussing the specifics of our investigation. I can tell you, however,
that in this instance we didn't find evidence that a violation occurred.

I understand your concern about this situation, and we can reopen the
investigation if we receive additional information about the possible
violation. Please feel free to contact the SafeHarbor team with
additional information about this account.

Thank you for your time.

Sincerely,
Collean
