Mr. Morgan paid $15.50 and $3.35 that is a big difference of $74.34 and a total of
196.53 total payment.

Steven, I understand  your concern. I've reviewed the listing you've won
item number 280194639256 and I noticed that your seller had included a
Shipping Rate Calculator in estimating the shipping price of the item,
in  placing your postal code in it, the calculator shows a value of
$20.89 which is the same shipping price listed in the invoice the seller
had sent you. 

I understand that you feel that this amount is excessive and I
understand your concern. At this time, I would encourage you to contact
your seller directly and try to work this out. I would recommend that
you communicate with him directly and ask him about the  shipping price
in his auction and amicably find a solution that could work for the both
of you.

To contact the seller, follow these steps:

1. Go to the item page and click on the seller's name.
2. Then click on the "Contact Member" button on the Member Profile page.
3. Write a message to the seller explaining your issue and then click
"Send."

If you prefer, you may want to ask your seller about the reason for his
shipping amount requested. If he told you that he's not satisfied with
the winning bid or that he would be using the money to cover up for his
eBay or PayPal fees, then this must be considered as a form of Fee
Avoidance. To report such activity, I would ask you to send us  a copy
of the email you received where the seller stated his reason for

What should you know for future reference?

The seller is responsible for determing the shipping and handling price
of their listed items. We always advise the bidders to be very careful
when bidding on auctions.  It is important that they read the entire
description so that there are no surprises if the seller has listed a
high shipping cost.  If you do not notice any specifics on shipping, you
should always contact the seller before placing a bid.

Listing items at a very low bidding price and high shipping price is
usually considered Fee Circumvention.  However, in order to take action
against these reports, the auctions must be reported before they have
ended.  Otherwise, we cannot take action against such a violation.

If you prefer,  you may also would want to consider offering your seller
to mutually cancel the sale. We can release both of you from obligation
to complete the transaction, but the process involved needs to be
initiated by the seller.

If you and your seller have agreed not to complete the transaction, your
seller can receive credit without harming your reputation. If the
seller's request for a Final Value Fee states that an amicable agreement
was reached, then going through the Unpaid Item process will not
negatively reflect on your eBay account.

As the cancellation of this transaction must be initiated by the
seller, I have provided you with information about this process. If the
seller does not know how to do this, please pass this information on to
him.

In these circumstances, eBay does not refund the initial listing fee. If

to me that you were also previously trying to report an excessing
shipping listing however, the listings you were trying to report
(280194639256 and 70205892056) seems to be already ended. I greatly
appreciate your effort in trying to report to us potential policy
violation and if you ever saw such listing you can easily report such
listings by clicking on the "Report This Listing" link at the bottom of
that listing page.

You can also report such listings by following the steps below:

1. 1) go to www.ebay.com

2) Click "Help" at the top of the page

3) Click "Contact Us" on the left side

4) Check the radio button : Listing Violations

5) Click "Continue".

6) Under Step 1 : Select a subtopic, Listing policy violations (improper
keywords, outside links, excessive shipping, etc)

7) Under Step 2 : Select a subtopic, choose "Other listing policy
violations"

8) Under Step 3 : example choose "Miscategorized items"

9) Click "Continue"

10) Click "Email Us" in the middle

11) Fill out the information with as much details as you can so that the
Trust and safety team can investigate the situation in greater detail.

 

 

It seem as though ebay is geared towards the seller and not the buyer, why would anyone want to contact the seller over a dispute, ebay representatives should settle a dispute.

Can I retract or cancel my bid?

A bid may be retracted (canceled) by the buyer in some cases if the retraction meets the requirements of our Bid Retraction policy.

Note: There is no equivalent for bid retraction in Buy It Now listings, or for listings where the bidding has ended. Once you've confirmed your purchase, you are obligated to pay the seller. There is also no equivalent for bid retraction for item listings using the Best Offer feature.

Whether you can retract your bid or not depends on the following factors:

  • Why you are retracting your bid.
  • When your bid was placed and when the listing ends.

Losing Feedback Privileges

Though it happens rarely, there are some circumstances when members can lose Feedback privileges. An eBay administrative note will appear under the Feedback comment on the Feedback Profile page, explaining that the member did not participate in the Unpaid Item process.

You should always respond to disputes opened within the Unpaid Item process. If you have resolved the situation outside of this process (for example, by making a payment by phone or email), please go back to the Dispute Console to enter a comment. Otherwise, you may lose your Feedback privileges for that transaction.

Note: When an Unpaid Item dispute is closed automatically, the buyer will lose Feedback privileges immediately. This happens when the buyer is no longer a registered user of eBay at the time of the Unpaid Item filing.

 

Unpaid Item Policy


 

Buyers automatically enter into a legally binding contract to purchase the item from the seller if they win the online auction or use the Buy It Now feature. eBay's Unpaid Item policy requires buyers to pay the seller for the items that they commit to purchase.

Sellers can file an Unpaid Item dispute with eBay for each of their items that are purchased but not paid for. eBay will issue a strike on the account of the buyer who does not honor their obligation to pay (unless the buyer and seller mutually agree not to complete the transaction).

Note: If a buyer gets too many strikes in too short a time period, their account will be suspended indefinitely. In some cases, limits may be placed on the buyer’s account in advance of suspension.

But yet ebay will allow a seller to charge Excessive Shipping Charges, so is ebay working for the buyer of the seller. What I can tell most people charge a descent shipping charge, then there are some that make a living on Excessive Shipping Charges. Please be careful!!!


I sent the seller an email stating that I have requested my bid be canceled and that I have requested ebay intervene on my behalf on what I believe to be Excessive Shipping Charges.

Abusing eBay

Fees and Services

Joining eBay and bidding on listed items is free. We do charge fees for using other services, such as listing items. Changes to that Policy are effective after we provide you with at least fourteen days' notice by posting the changes on the Sites. Liability

Release

Access and Interference

Indemnity

No Agency

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

Notices

Except as explicitly stated otherwise, legal notices shall be served on eBay's national registered agent (in the case of eBay) or to the email address you provide to eBay during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you legal notice by mail to the address provided during the registration process. In such case, notice shall be deemed given three days after the date of mailing.

Resolution of Disputes

If a dispute arises between you and eBay, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you and eBay agree that we will resolve any claim or controversy at law or equity that arises out of this Agreement or our services (a "Claim") in accordance with one of the subsections below or as we and you otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us directly to seek a resolution by going to the About Customer Support help page. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

  • Law and Forum for Disputes - This Agreement shall be governed in all respects by the laws of the State of California as they apply to agreements entered into and to be performed entirely within California between California residents, without regard to conflict of law provisions. You agree that any claim or dispute you may have against eBay must be resolved by a court located in Santa Clara County, California, except as otherwise agreed by the parties or as described in the Arbitration Option paragraph below. You agree to submit to the personal jurisdiction of the courts located within Santa Clara County, California for the purpose of litigating all such claims or disputes.
  • Arbitration Option - For any claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought is less than $10,000, the party requesting relief may elect to resolve the dispute in a cost effective manner through binding non-appearance-based arbitration. In the event a party elects arbitration, they shall initiate such arbitration through an established alternative dispute resolution ("ADR") provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
  • Improperly Filed Claims - All claims you bring against eBay must be resolved in accordance with this Resolution of Disputes Section. All claims filed or brought contrary to the Resolution of Disputes Section shall be considered improperly filed. Should you file a claim contrary to the Resolution of Disputes Section, eBay may recover attorneys' fees and costs up to $1000, provided that eBay has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim.

The following policies are part of this Agreement and provide additional terms and conditions related to specific services offered on the Site:

Each of these policies may be changed from time to time. Changes take effect when we post them on the Sites. General

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Appealing Unpaid Item Strikes and Suspensions

When buyers do not pay for items they have bought or won, they have violated eBay’s Unpaid Item Policy, and and eBay may issue a strike on the buyer’s account. However, sometimes a buyer may receive a strike despite having paid for the item.

An Unpaid Item strike can be removed if:

  • eBay is provided an accepted proof of payment by email, fax or postal mail or
  • eBay is provided with proof that the seller excused the buyer from their obligation or
  • The seller removes the strike themselves

Note: If you are a seller and would like to remove an Unpaid Item Strike from a buyer’s account, see Removing an Unpaid Item strike.

Accepted proof of payment

eBay accepts any of the following as proof of payment:

  • Copy of a check or money order – Send photocopies of the front and back of your check or money order (or money order receipt). Include the item number and your User ID.
  • Email communication between you and the seller – Send eBay copies of email that you sent to the seller. Please include the email headers.
  • Copy of payment confirmation from PayPal or other payment service – Send or email a copy of your payment confirmation email from PayPal or a confirmation email from another payment service. Please include the email headers.
  • Proof that the seller left you positive feedback for the transaction – If the seller left you positive feedback, send eBay an email including the item number so that we can verify the feedback.
  • Proof that the seller excused you from the transaction – Send a copy of the email showing that the seller excused you from the transaction. Please include the email headers.

Examples of Unpaid Item strike removals

Example 1 – Mary buys a lamp from Steve and mails him a check for the item. Unfortunately, the check is delayed in the mail for over 2 weeks. Concerned about non-payment, Steve files an Unpaid Item claim against Mary which results in Mary receiving a strike. The next day, Steve receives Mary’s check for payment and ships her lamp with an apology note. Mary can now appeal the unpaid item strike by sending a photocopy of the note and cashed check.

Example 2 – Sarah is purchasing designer glass beads from Colin. She wishes to buy 10 beads and places a multi-quantity bid for 10. She later finds out that she has bid on 10 lots and each lot contains 10 beads. Not knowing what to do with so many beads, Sarah only pays for one lot but offers her apology to the seller. Satisfied with the apology, Colin excuses Sarah from purchasing the remaining 9 lots and files an Unpaid Item claim to recover Final Value Fee credits. Sarah received an Unpaid Item strike, but she can now appeal that strike by sending the email communication excusing her from the transaction to eBay with the appeal.

I have checked too see if punishment has gone both ways on my complaint of Excessive Shipping Charges, and it seem, even though ebay stated that the I was correct on my complaint, nothing that I see has be done concerning the seller.

 
I have never removed a web page once I have posted the web page, so it seems I am the only person being punished.
 
I would like to know, under the Freedom of Information Act, what if any punishment the seller has received.
