The Wildlife Rehabilitation and Nature Preservation Society, known as (WRANPS), is located in Harrison County, Pass Christian, Mississippi, hired me as a contractor. This was an oral contract between Marilyn McQueary and Robin Berry. Marilyn McQueary stated she was the President, Robin Berry stated she was the Vice President, and later I was told that Bill McQueary was the Treasurer and Marilyn McQueary husband. I was contracted to finish a building that was built by friends of WRANPS. Marilyn McQueary and Robin Berry stated their friends had came out of New Orleans and over a period of weekends erected the building. I was contracted to place a privacy fence around the building, wire the building for electrical power, finish the inside walls and ceiling, build cabinets and a counter. I hired a crew of two construction workers and began the work; Marilyn McQueary gave me the key to the building so the work could get started. I ordered and paid for the construction materials, which were delivered, to the job site by West Building Materials, Gulfport, Mississippi.
The project was to be a simple task, but soon became a larger job. Marilyn McQueary and Robin Berry began changing and adding materials that were different from the materials discussed prior to the job beginning. They were told that this would increase the cost of the material and labor to the job, they acknowledged this and the program progressed. Either Marilyn or Robin would tell the crew or me what they wanted, and the material would be purchased at West Building Materials. Marilyn and Robin praised the work being done; either one or both of them were on the job site every day watching the progress being completed. The crew was also asked to perform work outside of the discussed project. They built and repaired large birdcages inside the privacy fence area.
The electrician I hired Mr. Gary Frank, a Master Electrician, was to wire the building and performed his work as requested by Marilyn McQueary and Robin Berry. Mr. Gary Frank performed extra work on materials added to the project. Mr. Frank was to complete his part of the project on a Saturday, the Friday night prior; I received a phone call from Bill McQueary, the Treasurer of WRANPS. He stated that discrepancies were found at the job site and for my crew and myself not to return to the job site and for me to turn in the key to the building. Bill McQueary stated they, Marilyn McQueary and Robin Berry along with himself, had already contacted their attorney, Reilly Morse, and he would be getting in touch with me. Since I was not allowed to return to the job site, all of my tools, which were left at the job site, were stolen by WRANPS.
This project began in 1991, it is now 1998, and I have to date not received one penny of the $7,790 of labor and materials I have spent on the project. This does not include any profit, sales tax, or the stolen tools. I have been trying to get the people and agencies listed above to provide me with help in bringing this to an end. But, as you will become to understand, a conspiracy against me was formed and is still going on now.
The attorney for WRANPS is Reilly Morse; the reason he is their attorney is because of his wife being involved with WRANPS. He has provided free legal service where I have had to pay for mine. The comment made by Bill McQueary the day before the job was to be finished, "We have already contacted our attorney and he will be getting in touch with you." This tells me they never intended to pay me for the labor and materials I had put into the job and already paid for. Do you see where the conspiracy is developing, and the conspiracy does not stop there.
I, in turn hired an attorney, Donald Rafferty, Gulfport, Mississippi. I paid $1,000 up front with two checks and the rest in cash. I have never received a receipt nor sign a legal contract, which is required by law. I explained to Donald Rafferty my situation and he explained how he would try to retrieve my money and tools without going to court. If this failed he stated he would take WRANPS to court.
After waiting for several weeks for a response on how the case was coming along. I phoned his office and was told by his secretary that he was working on the case. After waiting for several more weeks, I phoned his office and asked how the case was coming along, and again was told he was working on the case. This went on for eight months, and during the eighth month, I received a phone call from attorney Donald Rafferty telling me that he was going to quit the case. I told him he could not quit the case because it has been eight months and I was told that he would take WRANPS to court. I began taping the conversation and I told Donald Rafferty I was taping the conversation. He said he did not care if I was taping the conversation because there was nothing I could do to stop him from quitting. I contacted the Mississippi Bar Association, Jackson, Mississippi, www.mslawyer.com. I explained what had transpired and the Mississippi Bar Association sent me a complaint form to fill out and return. I filled out the form and sent it back and waited several weeks for the findings. When the letter came and I read the findings I was very unhappy, it stated that Donald Rafferty was not faulted for his actions. I was unhappy not only about the Mississippi Bar Association and their findings, but I was unhappy about how the complaint form was worded. You must understand that the Mississippi Bar Association, are all attorneys, and these attorneys are investigating attorney Donald Rafferty which claims to be an attorney. Do you see the picture, it's like a prison and the prisoners are in charge of the prison. Someone fills a complaint form and the prisoners must investigation one of their own. This is how the Mississippi Bar Association conducts their investigations. So it is reasonable that attorney Donald Rafferty was not faulted, in fact he told me on the phone that he did not care if I was taping our conversation because their was nothing I could do, like he already knew the out come of such an investigation. Also the complaint form itself was written to favor the attorneys, I crossed out the parts of the form which I felt was favored toward the Mississippi Bar Associations investigation and sent the form to the Bar. I also doubt their was ever an investigation conducted, I requested in accordance with the Freedom of Information Act, all documents pertaining to their investigation and so far I have not received any such documents.
I filled out the appropriate forms with the Small Claims Court, Gulfport, Mississippi, to have attorney Donald Rafferty pay my $1,000 back since he quit after eight months. I was given a court date and later I was contacted and told that the court date and time had been changed. When I arrived at Small Claims Court and walked into the courtroom, I noticed that I was the only person there. Later, attorney Donald Rafferty and his attorney and law partner came in and handed me a counter claim for another $1,000 dollars. So, here I am in Small Claims Court, with a female Judge, two bailiffs, Attorney Donald Rafferty and his attorney Whitmann which are/were law partners. It is obvious this was a setup, I have been to Small Claims Court twice before and the courtroom was full of people, so why was the courtroom empty for my case? I hope you see how much power attorneys have, I am sure none of us little people could make arrangements to have your own personal and private court case. If your wondering I did loose my case and the judge awarded Donald Rooftree the $1,000 counter suit.
I hired another attorney, Channing Powell, Gulfport, Mississippi. I, again paid $1,000 dollars up front, I did receive a receipt and signed a legal contract stating that I would pay $85 dollars an hour for his services. I have since, on two occasions, under the Freedom of Information Act, requested all document pertaining to his investigation. I also requested the help from the Mississippi Bar Association in order to obtain these documents but to date I have not gotten a response, and I have not received any document from the attorneys. After hiring attorney Channing Powell the waiting game started all over again. I kept calling and requesting the status of the case, I went to his office and tried to find out what the status was, but after waiting eleven months, Attorney Channing Powell told me he would phone WRANPS attorney, Reilly Morse. Attorney Channing Powell stated too me that WRANPS would settle by offering me $1,000. Talk about a slap in the face that was it. Lets review the progress, WRANPS decided not to pay me the day, which the job was to be completed. I hired attorney Donald Rafferty and he did nothing for eight months. I hired attorney Channing Powell; he does nothing for eleven months. I waited several months for the Mississippi Bar Association to investigate attorney Donald Rafferty. Now, by this time my Statue of Limitation has ran out (two years), can you see how the conspiracy has developed and it's not over yet.
During the time between when I hired Attorney Donald Rafferty, I conducted my own investigation. Here is what I found out, when Master Electrician Mr. Frank, went to the Harrison County Code Office to obtain the necessary electrical permit, he was told he could not obtain the permit because their was not a building at the location he was asking the permit for. This means that WRANPS had this building erected without obtaining the necessary permit to erect the building. I contacted Marilyn McQueary about the problem, and she told me she would check into it. Later she phoned me and stated that she had spoken with Mr. Tom Compton. Mr. Tom Compton is a physical sports instructor with the University of Southern Mississippi, Long beach, Mississippi. Ms. McQueary stated that Mr. Tom Compton told her to go ahead and have the electrician wire the building and he would take care of the problem. So I explained this to Mr. Frank and he wired the building but stated he would not wire the electrical panel because of not having the permit. It should be noted at this time that I explained to both attorney Donald Rafferty and attorney Channing Powell what the Harrison County Code Office had explained to me, but neither attorney acted upon the information.
I spoke to Mr. Clark, Director, Harrison County Code Office, and he told me that if there was a building located at WRANPS, he would have the build torn down, and if not torn down the building would never have electrical power hooked up to the building. This was stated to me three times by Mr. Clark. I took Mr. Clark for his word and considered him to be an honest person. What a mistake, I left the project February 1991, on December 16, 1991; electrical power was hooked up to the WRANPS building. When I found this out I phoned and requested a meeting at the Harrison County Code Office. The day I arrived at the Code Office I was escorted to a room in the back of the building. There were five people setting around a table, I was introduced to each person. The first words out of Mr. Clarks mouth was, "We cannot seem to find the file on WRANPS." My question was how and why was electrical power hooked up to the building, which never obtained the building permit. I questioned Mr. Clark about our three phone conversations where he stated that either the building would be torn down or electrical power would never be hooked up to the building. Mr. Clark did not answer, but the man setting at the opposite end of the table from Mr. Clark stated that he approved for electrical power to be hooked up to the building. He then threatened me by say, " IF YOU ARE GOING TO PURSUE THIS MATTER YOU BETTER GO FOR THE JUGULAR VEIN BECAUSE THAT IS WHAT I AM GOING TO DO." All I could say is why was power hooked up to the building and again no answer from Mr. Clark. I had gotten the feeling someone had gotten to Mr. Clark from the way he was acting. The person, which threatened me, placed his arm around my neck and walked me out to the parking lot, then turned around and went back into the building.
I phoned the Mississippi Power Company and spoke to Mr. Childers, Security. I explained why I was calling and he stated he would look into the matter and get back to me. Mr. Childers called a while later and explained that the Harrison County Code Office approved for electrical power to be hooked up on December 16, 1991. I explained how WRANPS had not obtained the necessary building permit nor could Mr. Frank obtain the necessary electrical permit. So therefore the Mississippi Power Company should not have allowed electrical power to be hooked up. Mr. Childers stated he had nothing to do with the permits, only the Harrison County Code Office has the authority to request and approve electrical power to be hooked up to a building. I requested under the Freedom of Information Act, from the Harrison County Code Office, all document showing how and why they approved electrical power to be hooked up to the building, but to date I have received no documents.
I have e-mailed the Mississippi Bar Association, Mr. Glen Waddle, all the information in this web page. I have re-filed three complaint forms and have received three docket numbers and three letters back from the Mississippi Bar Association. So now I wait, how long, I do not know, but I am certain the three attorneys will not be faulted. Remember the prison and the prisoners, I fully believe there should be a separate Independent committee overseeing all Bar associations.
I e-mailed Dr. Horace Fleming, President of the University of Southern Mississippi, Hattiesburg, Mississippi. The University owns the land, which WRANPS is located. I explained how I could not understand how, the University, could place itself in a position where the University would be criticized for the actions of wrong doings by WRANPS.
I have received an e-mail back from Dr. Horace Fleming, President, University of Southern Mississippi. He stated that he has been busy but he will look into my request.
I have contacted the Sun Herald Newspaper and WLOX-TV-13 on several occasions to investigate everything I have placed in this Web Page. But they refuse, they will not even acknowledge I have requested an investigation. I do not know why, but if I had to guess, the reason is that both have attorneys on staff, and they do not want to investigate three of their own. Which I find despicable and should be against the law, but look who makes the laws. I have also contacted Attorney Generals Office, Mike Moore, and requested his office investigate the Harrison County Code Office. I received a response that this was by law not in their scope of investigation. I have requested several investigations by the Attorney Generals Office, only to be told, "Not MY Job", or words to that effect.

I welcome your comments or questions, please send this web page to everyone you know. I may never retrieve my money or tools, but hopefully the attorneys will be disbarred from ever practicing law again. Maybe the Harrison County Code Office will be revamped by replacing all of the personal and replaced with honest people. Maybe the University of Southern Mississippi will move WRANPS off of their land and have the buildings torn down, there are two buildings, and I wonder if a building permit was ever issued for the first one.

Last night as I watched the 10 o'clock news, WLOX-13, I witnessed where the WRANPS showed the damage to the building and fence that I have $7,790 and profit and tools which were stolen by WRANPS with nothing to show for it. I watched as Katy Pope, the Director of WRANPS asking for volunteers and help in other ways to resolve the damages. I also read an article in the newspaper, Sun Herald, where WRANPS is again asking for volunteer and money to cleanup the hurricane damage. I have been requesting the Sun Herald Newspaper and WLOX-13 to place my story on the air and in the newspaper to show how I have been scammed by people which want but will not pay out what they owe.
I live about 2 city blocks for the Director of WLOX-13, I have noticed that his mansion has hurricane damage and several of his pecan trees have been sucked out of the ground. I would like to be able to say I feel sorry, but instead all I can think of is that it could not happen to a better man. I can remember one other times he and I spoke, I was the Commander of the Purple Heart Association. The association was having a meeting at the American Legion, Courthouse Road, Gulfport, Mississippi. I had called and request this meeting be covered by WLOX-13 to show the Purple Heart Association was active on the coast. I was assured by WLOX-13 that Ms. Wooten would cover the meeting. On the day of the meeting I called to make sure Ms. Wooten would be there on time. I again was assured she would be there. Ten minutes prior to the meeting starting I called again, and again was assured she would be there. But Ms. Wooten never showed up at all. The next day I phone WLOX-13 and complained where I was told that someone would get back to me. Later in the day I received a call from the Director, and here is what he told me. Ms. Wooten could not make the appointment because something more important came up. I asked what was the more important thing, but he did not know. His statement was this, IF THE GULF CAUGHT ON FIRE THAT WOULD BE A BIG STORY, and I had to agree. In other words he did not believe the Purple Heart Association was important enough to get covered and aired on his television station. I bet he also voted for Clinton also. I am sorry that I got off the subject of WRANPS scamming me out of money and tools with the help of WLOX-13 and Sun Herald Newspaper.

I believe it is time to get my request moving, I have waited for an answer on why the University of Southern Mississippi has allowed the Wildlife Rehabilitation and Nature Preservation Society (WRANPS) to build a building on their property. According to Mr. Clark, Director Harrison County Code Office, the reason the electrician was not able to obtain the proper electrical permits was because of WRANPS/USM did not obtain the necessary building permit. The University of Southern Mississippi owns the land, which the building in question is located. I had requested this same information in 1992, but of course never could get a straight answer. The three attorneys involved in this case were aware of this because I explained the situation to them. Donald Rafferty and Channing Powell, and Reilly Morse which was the attorney for WRANPS, and even though I did not personally explain about the building permit not being obtained he should have know. So lets get the ball rolling, I know the land is or was owned by the University of Southern Mississippi when the building was erected and you know the land is or was owned by USM. I want Justice; I have already been screwed out of money, profit, and tools. Justice is all that is left; I now know how a conspiracy works and how powerful our State and Local government is. But you know what they say, we have the best public officials money can buy, and how power corrupts and absolute power corrupts absolutely. I have requested the Mississippi Bar Association through claim forms that attorneys Donald Rafferty, Channing Powell, and Reilly Morse be disbarred from ever practicing law again. This is my second request on Donald Rafferty. I am not going away, I will sit here and write letters everyday until I feel Justice has been dealt with properly. Have you spoken to Mr. Tom Compton, he is or was in charge of your Physical Education. Department here in Long Beach. He is the person who stated to Marilyn McQueary that the electrician could go ahead and wire the building without a permit. He must have known someone either at Mississippi Power Company or the Harrison County Code Office. I will be writing to you several times a week requests until I am provided answers. I am sorry it has come to this but you should be in my position.
